Vonk Digital (“Provider”) agrees to furnish services to the subscriber of services (“Client”), subject to the following TOS (“Terms of Service”).
The provider reserves the right to change this TOS at any time. Such changes, modifications, additions or deletions shall be effective immediately upon posting on-line at this location. You acknowledge and agree that it is your responsibility to review this site and this TOS periodically and to be aware of any modifications. You may identify whether Vonk Digital has revised this TOS by noting the “Effective Date” above. Your continued use of the services after such modifications will constitute your: (a) acknowledgment of the modified TOS; and (b) agreement to abide and be bound by the modified TOS. If you do not agree to these terms, please contact us to cancel your services.
The provider’s services are offered on a monthly basis.
Payments and Fees
Establishment of this service is dependent upon receipt by Vonk Digital of payment of stated charges. Subsequent payments are due on the same day each month as your first charge. The accepted methods of payment are credit cards (Visa, Discover, MasterCard and American Express). Clients are responsible for any additional transaction fees that coincide with any payment methods.
By making purchase on www.vonkdigital.com, Client indicates that they have read and understood, and assents to be bound by, the terms of this Agreement. If the person making the purchase on www.vonkdigital.com is an individual working for Client (“Agent”), such person is agreeing to the terms and conditions of this Agreement on behalf of Client and certifies that he/she is an Agent of Client and has all necessary authority to act on Client’s behalf, including to bind Client to the terms and conditions of this Agreement.
If Client does not agree to the terms of the Agreement, Client is not granted any rights whatsoever in the Software. If Client is not willing to be bound by these terms and conditions, Client should purchase from www.vonkdigital.com, and may not access or otherwise use the Software or Services.
The Software / Services are licensed on a monthly, or annual subscription basis, as selected by Client or its agent. Access to the Software will begin (i) after your acceptance of this Agreement and after Vonk Digital receives and processes all the information, including the credit card or bank account information requested by the start-up interview form and completes setup of Client’s account. Client or its agent completing the start-up interview form must have a valid credit card or a valid debit card with a Visa, Discover, MasterCard, or American Express logo (“Card”) or sufficient funds in a U.S. checking or savings account to cover an electronic debit of the subscription fee to obtain access to the Software. The payment information Client or its agent provides must be accurate and complete, and Client agrees to notify us promptly of any change in the payment information. When Client subscribes and provides payment information, Client’s or its Agent’s (as applicable) Card or bank account will be debited, and will be automatically re-debited at the beginning of each applicable monthly, one-year or other pre-paid subscription term (“Renewal Term”) at the then-current subscription rate to maintain access to the Software.
The provider reserves the right to deny Client the use of any payment method for, but not limited to, abuse or misuse of a payment method. Abuse of a payment method may also be grounds for further disciplinary action up to and including the immediate and permanent cancellation of the Client’s services or their entire account with the provider.
Now that you have purchased your Vonk digital website, Whats next?
Please fill out and return the requested items from your representative as quickly as possible.
Once our production department has all this information they can begin to create your website with the content, logos and color schemes provided. This will usually take 2 business days to complete.
Once the first mock-up is completed your representative will give you access to view the site. At this time we allow you the client to scrub the site and decide on any changes you would like to see happen before going live. Send those edits to your representative and our production team will put those edits in place and have you a final product within 1-2 days. Vonk Digital does not edit internal page content unless discussed with account manager prior. The edit round includes the following pages, (home, meet the team, contact us, about us, and licensing). Home page design and layout changes are only included in semi-custom package.
***Please take your time during the “edit round” of the process and make sure you give us any and all your requested edits. If you decide that you want to make changes after the edit round you will be charged hourly for those additional updates.***
Final month of term is not pro-rated. Accounts are transferable to others provided you get written acceptance of the transfer from Vonk Digital prior to transfer.
Cancellation requests are accepted through email (send cancellation request to firstname.lastname@example.org) Past charges will not be pro-rated upon account cancellation. You must have all account information to cancel an account. Only the authorized account holder may cancel the account.
Refund and Disputes
All payments to Vonk Digital are nonrefundable. This includes prepayment fees, setup fees, and subsequent charges regardless of usage. Client shall not be entitled to any refunds, pro-rated or otherwise, in the event of early termination of this agreement by the provider according to the terms herein. All overcharges or billing disputes must be reported within 60 days of the time the dispute occurred.
Modifications to Web Site
Provider shall notify Client upon set up of Client’s Web Site. Any additional changes made to Client’s Web Site after set up, that Provider is required to make on behalf of Client, will be charged at Provider’s then hourly rate.
Website Data and Uptime
You are responsible for ensuring all functionality of your computer or mobile device and network connections that connect you to the service, including, but not limited to, “browser” software. We assume no responsibility for the reliability or performance of yours or anyone else’s internet provider or any connections or devices as described in this section.
Your access may be temporarily limited or suspended (a) during planned downtime for upgrades and maintenance of the service; or (b) during any unavailability caused by downtime, technical failures, acts undertaken by third parties (including by not limited to our hosting providers), connectivity issues on the internet networks, acts of god, acts of government, acts of terror or civil unrest, distributed denial of service or other attacks on the service; (c)if we suspect or detect any malicious software, code or activity within your account, (d) if you breach the terms of service or any other rule or law regulating the use of this service. Vonk Digital assumes no liability for downtime incurred due to any of the above downtime reasons and no liability for the loss of any customer data or other data directly or indirectly caused by one of the above mentioned malfunctions.
We reserve the right to refuse service to anyone at any time for any reason.
The provider is not responsible for data integrity on equipment reclaimed for non-payment.
Anything not explicitly stated in this TOS is subject to interpretation at Vonk Digital’s sole and absolute discretion.
You, as the Provider’s client, are solely responsible for the content stored on and served by Provider’s service.
